INTRODUCTION
This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder. It is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines) Rules, 2011, which require publishing the rules, regulations, privacy policy, and Terms of Use for access or usage of the marketplace e-commerce website namely https://www.homart.com and any related mobile application (hereinafter collectively referred to as the “Platform”).
This electronic record is generated by a computer system and does not require any physical or digital signatures.
The Platform is owned, operated, and managed by Homart Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013, having its registered office at [Insert Company Address] (hereinafter collectively referred to as the “Company”, “Homart”, “We”, “Us”, or “Our”).
By accessing, browsing, visiting, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by the contents of these Terms & Conditions (“Terms of Use”).
Except as otherwise specified, these Terms and Conditions do not apply to third-party products or services, which shall be governed by their respective terms of service.
TERMS
2.1 By accessing or using the Platform, you agree to be bound by these Terms of Use. We reserve the right, at our sole discretion, to modify or update these Terms at any time. These Terms constitute a legally binding agreement between you (“User”, “You”, or “Your”) and Homart.
2.2 A User shall mean any natural or legal person who accesses, browses, or uses the Platform for purchasing products or availing services. By accepting these Terms, you also agree to comply with our guidelines, policies, and Privacy Policy that may be updated from time to time.
2.3 If you do not agree with these Terms, you are prohibited from using the Platform and must discontinue use immediately.
2.4 Persons below the age of 18 years are not permitted to use the Platform without the supervision or consent of a parent or guardian.
USER REPRESENTATIONS
3.1 By using the Platform, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract under applicable laws.
3.2 You agree that all registration information provided by you on the Platform is true, accurate, and complete. If any information provided by you is found to be false or inaccurate, the Company reserves the right to suspend or terminate your account.
3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Homart shall not be responsible for any loss resulting from unauthorized access to your account.
3.4 You agree to use the Platform only for lawful purposes. You shall not attempt to hack, reverse engineer, decompile, or otherwise interfere with the functioning of the Platform.
PERSONAL DATA
4.1 We process personal data and sensitive personal data provided by you in accordance with our Privacy Policy. By using the Platform, you consent to the collection, storage, processing, and sharing of your personal information with authorized service providers as described in the Privacy Policy.

Upon receiving your request, we will process your account de-registration in accordance with our policies.
REPRESENTATIONS AND WARRANTIES
5.1 The Platform and its services are provided on an “as-is” and “as-available” basis. Your use of the Platform is at your own risk. To the fullest extent permitted by law, Homart disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Homart shall not be liable for:
- Personal injury or property damage arising from the use of the Platform or products sold by third-party sellers.
- Unauthorized access to secure servers or personal data stored on the Platform.
- Any interruption or suspension of services on the Platform.
- Any errors, omissions, or inaccuracies in content or product descriptions.
Homart maintains a grievance redressal mechanism and has appointed a grievance officer for handling customer complaints. Complaints will be acknowledged within 48 hours and resolved within one month from the date of receipt.
5.2 As a marketplace e-commerce entity, Homart does not impose cancellation charges on customers unless similar charges are borne by the Company or the sellers in case they cancel the order.
5.3 Homart records customer consent for purchases only when such consent is expressed through explicit and affirmative actions during the checkout process.
5.4 Refunds for approved refund requests shall be processed within a reasonable time frame as prescribed by the Reserve Bank of India (RBI) or other applicable authorities.
5.5 Homart, as an e-commerce marketplace, does not:
i. Manipulate prices of goods or services to impose unjustified charges on customers.
ii. Discriminate between users of the same category or arbitrarily classify users.
